RULES ON THE PROCESSING OF PERSONAL DATA

Rules on the processing of personal data by Leviatan-Poligrafia Sp. z o.o., ul. Rudawka 88, 43-300 Bielsko-Biała – personal data controller.


Leviatan-Poligrafia Sp. z o.o. processes personal data pursuant to the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, GDPR).

Leviatan-Poligrafia Sp. z o.o. limits the collected data to the minimum necessary to achieve the purpose for which it is collected.

The personal data collected by Leviatan-Poligrafia Sp. z o.o. shall be used for the following purposes:

the performance of agreements concluded;
taking actions before agreement conclusion;
the performance of legal obligations by the personal data controller;
those resulting from the legitimate interests pursued by the personal data controller, i.e.:

maintaining contact with business partners;

offering products and services;

detecting and preventing fraud;

ensuring the security of the company;

establishing, exercising and defending claims;

creating lists, analyses and statistics for internal purposes;

within the enterprise group to which the Employer/capital group belongs for administrative purposes and to ensure information security.

Personal data may also be processed on the basis of the data subject's consent for the purpose defined in the consent. Consent may be withdrawn at any time; however, this shall not affect the lawfulness of the use of the data prior to the withdrawal of such consent.

Personal data may also originate from other sources in compliance with the law, e.g.:

from banks (bank account numbers from which payments were made to Leviatan-Poligrafia Sp. z o.o.);

from public sources, including the National Court Register (KRS), Central Registration and Information on Business (CEIDG).

When using the data controller’s websites, information which identifies the network termination of the telecommunication network or the IT system from which the connection was made (including time stamp, IP address) may be stored.

Personal data shall be stored for a period of time resulting from the purpose for which it was collected, followed by a period after which the claims arising from this purpose become time-barred and for as long as legal provisions require that data to be stored. The personal data controller may also store personal data for a longer period of time only for reasons which are justified, if the law permits such data storage.

Personal data may be disclosed to the following recipients:

entities which operate IT systems or those who provide access to IT tools,

entities providing advisory, consulting and auditing services as well as those linked to debt collection, law, tax, accounting and HR-payroll services;

entities conducting payment activity (banks, payment institutions);

entities ensuring the physical protection of the data controller’s premises;

entities conducting postal or courier activity;

entities conducting debt collection activities;

other entities if data disclosure is necessary for legal reasons.

All persons whose personal data is processed by Leviatan-Poligrafia Sp. z o.o. have the right to access their personal data, and the right to rectify, erase, restrict the processing, the right to object and the right to data portability. These rights may be exercised by filing an application at the registered office of Leviatan-Poligrafia Sp. z o.o., ul. Rudawka 88, 43-300 Bielsko-Biała. The scope of each of these rights and the situations in which they can be exercised are determined by law.

All persons have the right to lodge a complaint with the President of the Office for Personal Data Protection if they decide that the processing of their personal data violates the provisions of law.


Information clause on employee recruitment

The personal data controller is Leviatan-Poligrafia Sp. z o.o., ul. Rudawka 88, 43-300 Bielsko-Biała.

The data controller shall process personal data for the purposes of the current recruitment process, unless a separate consent for the processing of personal data for the purposes of future recruitment is provided.

Personal data shall be used for:

conducting the recruitment process based on the consent provided;

purposes resulting from legitimate interests pursued by the personal data controller, i.e.: determination, assertion and defence of claims; within the enterprise group to which the personal data controller/capital group belongs for administrative purposes and to ensure information security.

The provision of data in questionnaires and forms completed when submitting a job application is voluntary; however, it is necessary for purposes linked to employment. The provision of additional data is optional and shall not influence the conclusion and course of the employment contract.

With the suitable consent, an automated analysis of a personal profile may be performed, which shall only have an indicative function for those making employment decisions.

Consent may be withdrawn at any time; however, this shall not affect the lawfulness of the use of the data prior to the withdrawal of such consent.

The personal data provided shall be stored for the duration of the recruitment process, and then destroyed immediately. The personal data controller may also store personal data for a longer period of time only for reasons which are justified, if the law permits such data storage.

Personal data may be disclosed to the following recipients:

entities which operate IT systems or those who provide access to IT tools,

entities which provide recruitment services or those which operate recruitment websites;

entities providing advisory, consulting and legal assistance services;

entities conducting postal or courier activity.

opening and maintenance of a client account at www.sklep.leviatan.pl

receiving from Leviatan-Poligrafia Sp. z o.o. of marketing content (commercial information) in the form of a newsletter sent by email to the email address provided – in the event of subscribing to the newsletter;

execution of orders placed at www.sklep.leviatan.pl (legal basis: implementation of the agreement);

resulting from the legitimate interests pursued by the personal data controller, i.e.:

communication linked to the functioning of www.sklep.leviatan.pl

establishing, exercising and defending claims;

within the enterprise group to which Leviatan-Poligrafia Sp. z o.o. / capital group belongs for administrative purposes and to ensure information security.

The provision of data is voluntary; however, it is reqired to open an account as well as to place an order and complete it.

The personal data controller may also store personal data for a longer period of time only for reasons which are justified, if the law permits such data storage.

Employee personal data may be disclosed to the following recipients:

entities which operate IT systems or those who provide access to IT tools,

entities providing advisory, consulting and auditing services as well as those linked to debt collection, law, tax, and accounting services;

entities conducting payment activity (banks, payment institutions);
